Terms of Download and Use of Images from the collections of Museu Terra (Fundació Carulla)

FUNDACIÓ CARULLA makes its database of items from the collections of its Museu Terra facility available to users, consisting of photographs of these items.

Free access to images via the Internet or through the website www.museuterra.cat does not imply their free availability for reproduction and/or dissemination.

Access to the database of items and the acquisition of images thereof is subject to Download and Use Conditions, which are set out below (hereinafter, Conditions).

Intellectual Property Rights: all copyrights, intellectual property rights, both in relation to patrimonial rights, of the texts, images, items, and data (hereinafter, MATERIALS) that can be accessed from www.museuterra.cat are the exclusive property of FUNDACIÓ CARULLA, with the right to assign to third parties, in whole and/or in part, for the maximum period legally provided until their entry into the public domain, worldwide, including the rights of fixation, reproduction, distribution, public communication, making available to the public, and transformation, including translation into any language and/or computer language, in any format, medium, support, and/or mode of exploitation, current and/or future, including secondary, derivative, and/or merchandising exploitations.

Authorized Uses: the use of the MATERIALS is authorized only by clicking the download button associated with the MATERIAL, provided that the use is limited to one or more of the following cases:

Non-commercial use
Personal or private use
Use in the academic field, within the framework of private research or study
Use within regulated educational institutions (schools, institutes, universities)
Non-profit publications (including: personal websites, personal blogs, and personal social media profiles, all of which are not sponsored and/or linked to a brand and/or a trade name and/or other entities)

Unauthorized Uses: if there is interest in other uses not foreseen in the above list, prior and express written approval from FUNDACIÓ CARULLA must be obtained. To request authorization for other uses, the interested party must send a reasoned written request to the following email address: documentalista@museuterra.cat. Authorizations are handled on a case-by-case basis in strict order of arrival, under the exclusive discretion of FUNDACIÓ CARULLA. A use may be subject to a fee depending on the nature of the proposed use.

Obtaining Higher Resolution Images: the interested party wishing to download a higher resolution image must send a reasoned written request to the following email address: documentalista@museuterra.cat. Requests are handled on a case-by-case basis in strict order of arrival, under the exclusive discretion of FUNDACIÓ CARULLA. Obtaining the higher resolution image may be subject to a fee, depending on the nature of the use the interested party wishes to give the image.

Use by Interested Parties: MATERIALS for which authorization of use has been granted must be used in accordance with the following requirements:

Limitation and Termination of Authorization: FUNDACIÓ CARULLA reserves the right to terminate a use authorization or to not authorize it if it considers that the use in question is negatively affecting the image, name, and prestige of FUNDACIÓ CARULLA, its board members, employees, assignees, licensees, and/or successors, or may be contrary to the Law, good customs, and these Conditions and/or be detrimental to the rights and interests of third parties.

Prohibition: it is strictly prohibited to send and transmit illegal, threatening, or fraudulent material linked to the MATERIAL, which will constitute criminal conduct with civil and/or criminal liabilities. FUNDACIÓ CARULLA has the right, but not the obligation, to inspect, monitor, review, edit, remove, refuse, and/or delete any content that includes MATERIALS and is contrary to these Conditions.

Disclaimer: FUNDACIÓ CARULLA does not guarantee that the use of the MATERIALS by interested parties will not infringe upon third-party rights, and therefore, FUNDACIÓ CARULLA, its board, its employees, its assignees, licensees, and/or successors assume no responsibility that may arise from the content in which the MATERIALS are incorporated, the treatment given to the MATERIALS, the media, formats, and modes of use applied to them, and/or as a result of errors, defamation, slander, omissions, falsehoods, obscenities, pornography, dangers, and/or inaccuracies committed by authorized persons and/or by third parties using the MATERIALS.

Privacy Policy: personal data provided by interested parties to request Unauthorized Uses or Higher Resolution Image Acquisition will be processed in accordance with FUNDACIÓ CARULLA’s Privacy Policy.
